Consent to issue passport with minor children

Citizens who are parents of minor children, are kindly informed that starting from the 14 June 2023, Italian Law (D.L. 69/2023) will no longer require consent from the other parent for the release of their own Identity documents (i.e. Passport/Identity Card).

Specifically, the new addition to article 3-bis of Italian Law L.1185/1967 indicates that, when there is a concrete and actual danger of parental obligations being evaded due to the transfer of the minor abroad, it would be possible for the other parent to request a restriction to the release of the document.

The request may be presented via the competent Judge of the ordinary Tribunal/Court where the minor has their residence or, if the minor lives abroad, via the Tribunal/Court in the district where the AIRE municipality is located in.

With regards to the release of documents for minor children, the obligation of having consent signed by both parents (or the legal parental guardian) STILL REMAINS.
